This was a landmark Jersey case on the enforceability and effect of restrictive covenants in employment contracts, which also introduced the concept of constructive dismissal into Jersey law

In 2006, the Opera House was involved in employment disputes with several of its employees, two of whom issued a JET1, Michael Hamilton and Ian Stephens. Their respective wives also threatened to bring claims in the Employment Tribunal. There was a lot of press coverage following the resignation of Ian Stephens in June 2006. His employment claim was listed for a 3 day hearing in November 2006. Mr Stephens represented himself and our Advocate Santos-Costa and Colette Hunt represented the Board of Directors of the Opera House. Following the opening submissions at the Tribunal hearing and just as Mr Stephens was about to begin to give his evidence, there was an adjournment and discussions took place between the parties which resulted in terms of settlement being agreed. As the terms of settlement were confidential, it is not possible to comment further. Due to the high profile that the claim had on the island, a joint press statement was issued, the wording of which was agreed by all the parties. Following this instruction, the firm was appointed as the Opera House’s lawyers and is also the main sponsor of this summer’s 2007 hit musical “Buddy”.
